Terms of Sale, Payment and Delivery
1. General
The general sales, payment and delivery ("GTC") are sent to the buyer together with our price lists and product catalogs. By placing an order, the customer acknowledges the validity of GTC. Other terms and conditions of the customer on order forms that deviate from these GTC are not legally binding for us if we have expressly agreed to them.
2. Order / orders
You can actively help to speed up the processing of your requests and orders by specifying, in each case, our item number. Incoming orders will be confirmed on request.
3. Prices
The catalog prices are recommended prices in euro and are always subject to change due to our gross stock from the warehouse in Bischoffsheim (France). We reserve the right to adjust the prices without prior notice in daily conditions. VAT is not included in the prices charged and is in the respective legal amount billed separately. Special offers for bulk orders upon request. With the issue of a new product catalog, a new price or discount list, all previous prices and special offers are not valid anymore.
4. Resale discounts
The re-sale discounts are based on the current separate resale discount lists, attached to the price lists.
5. Repairs, spare parts
Repairs and the supply of components and spare parts are carried out without a processing fee. Products to be repaired under warranty are to be delivered by carriage paid. For repairs that after inspection are not being executed due to cost reasons, and for demanded cost estimates, a cost share of EUR 20.- will be calculated.

Tool Trolleys – Made in Germany
KRAFTWERK provides a 7-year manufacturer’s warranty on all tool trolleys made in Germany. This warranty covers the entire tool trolley, including all assemblies and wear parts (e.g. worktop, castors, drawer slides, locks, handles, and surfaces), provided that the defect is due to a material or manufacturing fault.
Excluded from the warranty:
-any tools contained in or attached to the trolley
-damage caused by improper handling, overloading or misuse
-third-party interventions or unauthorised modifications
The warranty includes free repair or replacement of defective parts. Repair or replacement does not extend the original warranty period. Statutory warranty rights remain unaffected by this manufacturer’s warranty.
Cutting Tools
For cutting tools, claims can only be reviewed if a sample of the material on which the cutting edge became defective is enclosed. The purchaser bears the shipping costs for the defective product and the material samples. If the defect is confirmed, KRAFTWERK will provide a replacement free of charge. We reserve the right to include the replacement with your next order or to issue a credit note. Please note: defective products cannot be returned in their original condition, as they may be damaged during inspection.

7. Delivery times, delivery delay
The agreed delivery times are tried to be met if somehow possible. However, they are non-binding. Partial and subsequent deliveries are possible. If we fail to comply within the specified delivery times, the customer may not complain to us in any case. Orders and subsequent deliveries can only be canceled for failure of completion within the delivery time if the customer has indicated in writing to a delivery delay and a reasonable in writing scheduled extension of the delivery period has elapsed.
8. Delivery
Basically, we supply from our warehouse EXW Bishoffsheim. For direct deliveries to your customers a processing fee of EUR 25.- is being charged. Costs and fees for express delivery and mail delivery will in every case be fully charged to the customer. Delivery fees are charged to the customer. Shipment is always at risk for the buyer, even with carriage paid deliveries. The risk of accidental loss or deterioration of the goods is transferred or from our stock in Bischoffsheim or from the stock of the respective representative to the customer. Shipping damage and missing packages are to be certified and claimed immediately upon receipt by the purchaser to the carrier as we do not replace them.
9. Subsequent delivery
Non-stock or short-term available products will be supplied upon receipt carriage paid. We reserve the subsequent delivery together with the following order, subsequent deliveries will be delivered to the current prices on the delivery date. For non-stock products there is no duty for subsequent delivery.
10. Retention of title
We reserve the ownership of the goods delivered until full payment of the purchase price. The buyer is obliged to take the necessary measures to protect our property.
11. Complaints
Deliveries are to be reviewed by the customer immediately upon receipt and complaints regarding quantity, price or quality are to be reported in writing within 8 days after receiving the goods. Recognized deficiencies are regulated at our discretion either by repair, replacement, exchange or refund. Further claims by the purchaser as compensation for non-performance or consequential damage are excluded.
12. Returned Goods
Ordered and correctly supplied goods will only be accepted as returned goods if we approve a redemption in writing in advance. The return must be made stating the invoice number and date. The expenses resulting from the approved return shipping charges are paid by the returner. He also carries the risk of returning. For the return we have 10% of the product value (at least EUR 25.-) calculated as cost recovery. The re-salable withdrawals in original packaging will not be credited but offset against outstanding receivables or future deliveries. Articles from special-/factory orders cannot be returned.
13. Payment
Payment within 30 days net without discount. Discount and collection costs are borne by the purchaser. The withholding of the payment and billing / offsetting of any counterclaims is excluded. For late payment, charges and interest will be charged at the currently applicable discount rate. Unauthorized deductions will be debited.
14. Measures and Pictures
In brochures, catalogs, circulars, advertisements, price lists or in the offer documents belonging to specifications, drawings, illustrations, technical data, weight, dimensions and content descriptors are not binding unless they are expressly designated by us as binding. Subject to change without pervious notice. The information contained in our catalog text, pictures and drawings are subject to copyright protection. Reproduction (also partly) is only permitted with our written permission.
15. Place of performance and jurisdiction
Place of performance and jurisdiction is in any case, Uster, Switzerland. However, we are entitled to sue the purchaser at the competent court for his commercial Establishment.
